MISSISSIPPI RIVER NOW OPEN TO TRAFFIC AFTER BARGE-TANKER COLLISSION AND SPILL

August 4 - The US Coast Guard has announced that the entire length of the river is open to navigation, but safety restrictions remain in place. Salvage operations on the partially sunken barge Tintomara continues. More than 500 vessels have been cleared and released since operations began on July 23. A summary of findings was announced by USCG pending a full investigation.

HOUSTON AREA MAN SENTENCED FOR IMPROPERLY HANDLING REGULATED GARBAGE

HOUSTON, August 4 - Patrick H. Stinson, of Conroe, Texas, has been sentenced to two years probation for violating the Animal Health Protection Act (AHPA), United States Attorney Don DeGabrielle announced today. The violation occurred in connection with the operation of his business, Marine Waste Services, in the receipt and storage of certain waste products collected from commercial shipping vessels arriving in the Southern District of Texas after traveling to foreign ports. This is the first criminal enforcement of the 2002 Animal Health Protection Act in the Southern District of Texas.

NYK FINALIZES AGREEMENT TO TRANSPORT BIOFUEL

August 5 - NYK has concluded a three-year charter contract with Japan Biofuels Supply LLP (JBSL) that comes with an option to extend the contract for two additional years. A 37,000 DWT class chemical tanker will be used for shipments of the biofuel bio-ETBE (ethyl tertiary-butyl ether).

NYK TO BUILD NEW REVOLUTIONARY CONTAINER HANGAR

August 4 - NYK will be building a state-of-the-art container hangar, the first of its kind, at its Oi Container Terminal in Japan. According to the company, the new hangar which will be built in 2010 and be operational by 2011, will improve yard usage, lead to increased efficiency in loading and unloading, and result in operations that are much more environment friendly.

PANAMA CANAL REPORTS 4.5% HIGHER TRANSITS

PANAMA CITY, July 28 - The Panama Canal Authority (ACP) released ITS third quarter (Q3) operational metrics today for fiscal year (FY) 2008. In Q3, total Canal transits and tonnage increased. There was also growth in key segments, most significantly tanker and passenger transits. These metrics are based on operations from April through June 2008, the third quarter of the ACP's 2008 fiscal year, and are compared with Q3 of FY 2007.

USCG - INADEQUATELY LICENSED PERSONNEL WERE MANNING TUG BOATS

NEW ORLEANS, July 29 - A preliminary US Coast Guard investigation has discovered that the crewmember piloting the tug boat Mel Oliver, which collided with the chemical tank ship Tintomara early Wednesday morning spilling 420,000 gallons of fuel oil into the Mississippi River, held an apprentice mate's license.
This discovery is seen as a major violation of maritime safety rules, according to USCG. Digging deeper, the agency found a number of recent incidents involving tug boats owned or operated by DRD. Another tug boat operated by DRD Towing, Ruby E, was involved in an incident on July 13, 2008, resulting in the sinking of that vessel. The preliminary investigation into that incident revealed that the crewmember piloting the Ruby E also held an apprentice mate's license. Under US maritime rules, apprentice mates require the presence of a licensed master on board, which was absent on both the Mel Oliver and the Ruby E.

SHIPPING RESUMES IN MISSISSIPPI RIVER

WASHINGTON, July 28 - The United States Coast Guard has cleared the limited resumption of shipping along the Mississippi River last Friday. The river was closed since July 23 following the collision between a ship and a barge that resulted in a spill of 1.5 million liters of fuel oil that closed a 100-mile section of the river.

INDIAN GOVT OKS SOURCING OF SHIP OFFICERS FROM 12 COUNTRIES – BUT NOT YET FROM PHILIPPINES

July 28 – The Indian transport ministry has given the green light for Indian shipowners to start recruiting badly needed ship officers from an approved list of 12 countries – which does not yet include the Philippines. Calling the request from shipowners “reasonable and in the national interest”, the director general of shipping issued the approval and the sourcing list last week. The list includes Bulgaria, Croatia, Estonia, Georgia, Latvia, Lithuania, Italy, Malaysia, Romania, Russia, the UK and Ukraine. However, the Indian Shipowners Association is petitioning for the addition of at least nine other countries which include Sri Lanka, Bangladesh, Myanmar, Singapore, Hong Kong, Indonesia, Vietnam, Thailand and the Philippines from where they believe recruitment will be easier.

US NTSB: MASTER'S POOR DECISION LED TO GROUNDING OF ‘EMPRESS OF THE NORTH’

Washington, DC July 22 - The United States National Transportation Safety Board has determined that the probable cause of the grounding of the Empress of the North was the failure of the officer of the watch and the helmsman to navigate the turn at Rocky Island, which resulted from the master's decision to assign an inexperienced, newly licensed junior third mate to the bridge watch from midnight to 4:00 a.m. The third mate was not familiar with the route, the vessel's handling characteristics, or the equipment on the vessel's bridge.

MANILA, July 20 — The Supreme Court, in a 10-page decision, affirmed an earlier ruling of the Court of Appeals (CA) which states that shipping company Neptune Orient Lines (NOL) and agent Overseas Agency Services, Inc.
(OASI) is only liable to reimburse shipper Fukuyama Manufacturing Corporation and its insurer, Philippine Charter Insurance Corporation (PCIC), US$ 1,500 for three sets of warp yarn which was lost at sea during the course of the voyage from Hongkong to Manila in 1993.

MANILA, Philippines - Nearly a month after government suspended its operations over the capsizing of the MV Princess of the Stars, Sulpicio Lines Inc. has laid off 136 of its workers in Cebu. DZBB Cebu reported Thursday that the management blamed the suspension for the layoffs, citing losses of some P1 million a day.

K LINE STARTS OFFICER UPGRADE TRAINING ON THIRD TRAINING SHIP

July 10 - K Line’s newest 80,000m3 type LPG Carrier Summit River was delivered today and immediately sailed for her maiden voyage. Summit River is one of K Line’s training ships for up-grading of officers, with an additional six berths for trainees with individual shower and toilets. The vessel’s master and chief engineer also perform roles as instructors. K Line’s statement further said two navigation officers and two engineers have been onboard as trainees before her delivery at dockyard.

SEN KERRY INTRODUCES LEGISLATION TO PROTECT PASSENGERS ON CRUISE SHIPS

WASHINGTON, D.C. July 8 – Senator John Kerry today introduced legislation that would improve cruise ship safety and accountability. The Cruise Vessel Security and Safety Act of 2008, S. 3204, would require crimes aboard cruise ships to be reported to the Coast Guard and FBI. Cruise ships, which operate under foreign flags, are not currently required under U.S. law to report crimes that occur outside of U.S. territorial waters.

MANILA, July 3 -- Sulpicio lawyer Arthur Lim on Thursday asked the seven-man panel not to jump into conclusion that the ship was not stable and that ship officials made some lapses when the M/V Princess of the Stars set sail during the continuation of Board of Marine Inquiry (BMI). Lim testified before the BMI’s panel, headed by Rear Admiral Ramon Liwag, as to the seaworthiness of the vessel which left the port of Manila on the night of June 20. Also during the hearing, Sulpicio Manila port Capt. Benjamin Eugenio testified that the ship was in good running condition when it set sail toward Cebu, the port of destination. He also said that all the cargoes were properly lashed and placed in safe areas inside the vessel.

MAERSK LINE ORDERS 16 NEW CONTAINER VESSELS

July 3 - A.P. Moller - Maersk has signed an agreement with Daewoo Shipbuilding and Marine Engineering Co. Ltd. in Korea for the delivery of 16 container vessels in 2010-12. The vessels have individual capacities of 7,450 TEU and equipped with reefer plugs enabling them to carry 1,700 refrigerated containers each. This is the highest number ever carried on a container vessel.

MAERSK REVISES ASIA - EUROPE SERVICES DUE TO FUEL CONSTRAINTS

June 30 - Maersk Line has announced changes to its Asia - Europe services, saying that fuel costs are increasing significantly and “we find it necessary to take measures to ensure the sustainability of our services.” In early July 2008, the AE5, AE7, AE2, and AE8 services will undergo minor changes in order to remove capacity from the Maersk network which it hopes will improve its bunker picture. This move is expected to reduce space by 2,000 FFE (forty-foot equivalent) per week while keeping all corridors served in the network.

TOKYO, June 25 - The member lines of The New World Alliance (TNWA) and the Grand Alliance (GA) announced yesterday a jointly operated service from Asia to the Black Sea starting mid-June 2008. MANILA, June 23 - Sulpicio Lines on Monday denied that its ship, the “M/V Princess of the Stars” capsized due to engine trouble at the height of Typhoon "Frank." Sally Buaron, vice-president for passage of Sulpicio Lines, Inc., claimed that the vessel was in "tip-top" shape and “never recorded any problem” during its entire operations since they acquired it in May 2001. “We have certificates to show that the vessel is seaworthy and has the necessary compliance certificates and never it recorded any problem, kaya nagtataka kami bakit sinasabi nasira ang makina (that's why we were surprised that there was engine trouble),” Buaron said during a press briefing Monday.

COAST GUARD FROGMEN START CUTTING HOLES ON SHIP'S HULL IN SEARCH FOR TRAPPED PASSENGERS

MANILA, July 24 -- Frogmen from the Philippine Coast Guard on Tuesday are set to cut holes on the hull of the sunken "M/V Princess of the Star" to check on bodies trapped inside the vessel. The Cebu-bound ship, carrying 849 sank off Sibuyan Island in Romblon at the height of Typhoon Frank last Saturday.
